The draft amendment to the Nature Protection Act being debated in the parliament seeks to give local authorities greater flexibility in reducing building restriction zones in towns, cities, and urban centres. The amendment aims to simplify construction activity in densely populated areas, where strict existing restrictions have often hindered development in densely populated regions.

The opposition party Estonian Fatherland has taken a critical stance on the draft. According to an Estonian Fatherland MP, the legal amendment could bring unintended consequences: while construction becomes easier in urban areas, it could become more complicated near waterbodies in rural areas. Such contradictory effects raise questions about the draft's balance.

The building restriction zone has so far protected waterbody banks and their immediate surroundings from excessive construction activity. Changing the restriction zone boundaries at the local authority level would indeed give local authorities greater autonomy, but this also requires a responsible approach in considering environmental factors. The critical question is whether decisions made at the local authority level ensure adequate nature protection.
